The following Terms & Conditions “Terms” govern all entries to Competitions operated by Strike6 Ltd. By submitting an entry, you agree to abide by and be bound by these terms, which you should read carefully. 1. General 1.1 The strike6 service is offered by Strike6 Ltd, a company registered in England and Wales with company number 4487871 and whose registered office is situated at St Michaels House, Norton Way South, Letchworth, Herts, SG6 1NY, United Kingdom. All references in these rules to “we” and “us” are references to Strike6 Ltd. 1.2 All references in these Terms to our ‘website’ are references to the website at www.strike6.com. 1.3 These Terms govern the relationship between you and us and incorporate the terms upon which you place using our service. Please read these Terms carefully and ensure that you fully understand them before agreeing to being bound by them. 1.4 We may amend these rules from time to time. Notification of any such amendment will be posted on our website. Each amendment will become effective, and you will be deemed to have accepted any such amendment, immediately as it is posted on our website. 1.5 Entries may only be placed online via our website. Our service will be extended to enable access by SMS phone messaging and interactive TV, and notice will be published on our website once these media sources become operational. Subject to the above, entries may not be accepted or offered via any other medium, whether by telephone, fax, post or otherwise. 1.6 These terms shall be governed by and interpreted in accordance with English law, and you agree to submit to the exclusive jurisdiction of the English courts in connection with any dispute that may arise regarding the use of our service. 2. Conditions of Entry 2.1 In order to enter, users are required to complete their details on the User Registration Form. Completion of this form by you will authorise us to maintain an account registered in your name (strike6 account). 2.2 Among other details, you will be asked to choose a password when completing the Registration Form. You must keep your password confidential, as all entries made using your password will be treated as valid and as having been made by you. If you have reason to believe that a third party may be in possession of your password, you will be required to change this immediately on the registration page by going to ‘edit account’. 2.3 You are not permitted to become a Registered User to use our service if you: 2.3.1 are under 18 years of age or acting on behalf of a person under 18 years of age. 2.3.2 are a bookmaker (as defined in Section 55(1) of the Betting, Gaming and Lotteries Act 1963) or an employee of a bookmaker acting in the course of your employment; or 2.3.3 live in, are resident in, or access our website from a country where betting is illegal or prohibited. 2.4 It is your responsibility to comply with your own national laws applicable to the use of our service. 2.5 We reserve the right, at our absolute discretion, to refuse to register you as a Registered Player or suspend and/or terminate your registration as a Registered Player at any time without explanation. Any such decision will not affect outstanding entries to our Competition. 3. Submitting an Entry 3.1 For an entry to be valid, you must receive confirmation from us that the entry has been received by us. A confirmation message will appear on the screen and any entry will be deemed confirmed when the relevant entry charge has been deducted from your account balance indicator. Once this confirmation is displayed, entries cannot be cancelled. 3.2 We reserve the right to refuse to accept entries. In such case, you will not receive a confirmation message on your screen. 3.3 All entries must be received 1 hour prior to the first game kicking off, at which time the website will cease taking any more entries. All entries will be logged and submitted to a third party on the same day. 4. Your strike6 account 4.1 On becoming a Registered Player of strike6, a strike6 account is automatically opened once you have made the minimum deposit of £10. 4.2 Once the outcome of a strike6 competition has been determined, we will email you within 24 hours to confirm winning amounts. Proof of identity may be required and cheques will only be made payable to the strike6 account holder. 4.3 It is the responsibility of the account holder to ensure that their registration details are kept up to date and strike6 accepts no responsibility for any failure on the part of the account holder in this or any other respect. 4.4 You will only be allowed to submit an entry up to the amount of the current available balance in your strike6 account. Once your account is £0, you will have to ‘top up’ your account. 4.5 Balances held in your strike6 account will not bear interest. 5. Disqualification 5.1 A coupon or a particular entry will be disqualified and we will not make any payment in respect if: 5.1.1 it is submitted by a person under 18 years of age; or 5.1.2 it is not submitted to us in accordance with these terms or if there is any breach of these, or: 5.1.3 the genuineness of any entry is considered by us to be doubtful. 6. Disclaimer and Limitation of Liabilities 6.1 Save for any manifest error by us, we accept no responsibility whatsoever and shall not be liable for any consequences that are alleged to have accrued through your use, or misuse, of our service. In particular, entry of our service in certain jurisdictions may be illegal and it is your responsibility to ensure that you comply with your own national laws governing your use of our service. If Internet gambling is illegal in the jurisdiction in which you are located, are resident or live, you are not permitted to use our service. We shall not be liable for any failure by you to comply with such laws. 6.2 We shall not be held liable or in any way responsible for any consequences that are alleged to have occurred through your use of our service where the circumstances were beyond our control. 6.3 Any attempts made to deliberately damage the strike6 website and/or undermine the legitimate operation of strike6 is or may be a violation of criminal and civil law and should such an attempt be made, we will seek damages as permitted by English law. 6.4 We shall not, in any way, be responsible for any acts or omissions made by your Telecommunication Service Provider (‘TSP’) with whom you have contracted to gain access to our website and you agree that we shall not be a third party to any dispute between you and TSP. 6.5 If, through your use of our service, you cause us to publish, whether on our website of otherwise potentially defamatory, obscene or offensive material, you agree that you shall be solely liable for the publication of such material and that you will indemnify us for all costs, penalties and charges incurred by us in relation to such publication. This clause 6.5 equally applies to your choice of user name, nickname and team name. 6.6 We accept no responsibility and shall not be liable for the content of or use by you of any information or services offered by parties advertising on our website (whether directly or via links to other websites or resources) nor do we endorse the content of such advertisements. 6.7 Our service is approved without any express warranties or guarantees, unless specifically stated, and to the extent permitted by any applicable law, without any implied warranties or guarantees. 6.8 We accept no liability for entries made resulting from the disclosure by you of your password to any other person, whether such disclosure is made negligently or otherwise. You must keep your password confidential, as all entries made using your password will be treated as valid and as having been made by you. 7. Commission and Expenses 7.1 Our commission and expenses in respect of strike6 is 60% of the total stakes. This clause 7.1 shall serve as the relevant notice to participants in the Competition, pursuant of Schedule 2 of the Betting, Gaming and Lotteries Act 1963. Our Commission for the season 2004/2005 and 2005/2006 has been less than 3%. 8. Accountants 8.1 In the interest of fairness, a firm of accountants will supervise the implementation of these Terms and verify the calculation and payment of all winnings in accordance with the Betting, Gaming and Lotteries Act 1963. Any dispute arising in connection with the operation of any competition and/or the interpretation of the Terms, shall be adjudicated by the accountants on request, and their decision shall be final and binding on all parties including ourselves 9. Copyrights and Trademark 9.1 All of the material on our website, including text, graphics, photographs, pictures, sounds, data, images, audio clips (“The Material”) are the exclusive property of Strike6 Ltd and/or the companies or individuals who supply us with the Material. The Material, including compilation, selection, presentation and arrangement thereof, is protected by national laws and international agreement on copyright, moral rights, and other intellectual property rights. You may only use the Material, for your own personal information, and reproduce extracts of the Material for strictly personal purposes, without prejudice to the copyright in works featured in the Material. Any other form of use (including particular reproduction, translation, alteration, modification, distribution, transmission, re-publication, display, broadcast or public representation of the Material) is strictly forbidden. 9.2 The strike6 name and logo, and any other graphics, logos and trademarks used on our website are protected by the laws and international agreements on intellectual property. Our trademark must not be used in association with the products or services of a third party or in a manner which could, either directly or indirectly defame or discredit us or a third party. In assessing the Strike 6 Football Service you agree that you will access the contents solely for your own private use but not for any commercial or public use. Except as permitted above, you undertake not to copy, store in any medium (including in any website), distribute, transmit, re-transmit, broadcast, modify, or show in public any part of the fixtures lists without the prior written permission of Football DataCo Limited or in accordance with the Copyright, Designs and Patents Act 1988. Applications for written permission to reproduce any part of the fixtures lists should be addressed to Football DataCo Limited, 11 Connaught Place, London, W2 2ET. WARNING: The doing of any unauthorised act in relation to a copyright work may result in both a civil claim for damages and criminal prosecution. 10. Privacy Policy 10.1 We are committed to protecting your privacy. As required by the UK Data Protection Acts 1984 and 1998 we follow strict security procedures in the storage and disclosure of the personal information you give us in your Registration Form in order to prevent unauthorised access. 10.2 In order to become a Registered Player and use the service on our website you must complete our Registration Form, and so provide us with certain personal information about yourself such as name, address, telephone number, email address. 10.3 Credit information that you will need to supply will be processed by WorldPay under their strict procedures ensuring your personal credit details are securely protected. Promotions 11.1 We will from time to time run promotions that will be offered to all Registered Players. Details of such promotions will appear on our website or be forwarded to you directly, via your internal mailbox. In this regard we reserve the right to alter or cancel a promotion at any time, by appearing on our website or in your internal box. 12. SMS Game - Goal Strike SMS Entry 12.1 SMS entries will cost £1.00. After deducting mobile network charges (approx 50p) the balance will used as the entry fee to the game. 12.2 We cannot accept any liability for SMS entries not forwarded or received from the mobile networks.
